Landmark Ruling of the Singapore Court of Appeal on Unconditional Performance Bonds in Building Contracts

Abstract:

In a recent Singapore Court of Appeal decision (CKR Contract Services Pte Ltd v Asplenium Land Pte Ltd and another and another appeal and another matter [2015] SGCA 24), it was held that a clause stipulating, amongst other things, that a main contractor was not (except in the case of fraud) entitled to restrain a call on a performance bond on any ground, including the ground of unconscionability, was valid and enforceable.
